Who Determines DD Waiver Eligibility in New Mexico?

How is DD Waiver Eligibility Determined?

Eligibility for the Developmental Disabilities (DD) Waiver in New Mexico is determined by the Pre-Service Intake Bureau (PSIB) of the Developmental Disabilities Supports Division (DDSD).

A Pre-Service Specialist reviews all submitted information to confirm whether the applicant meets the DD Waiver eligibility criteria outlined in New Mexico Administrative Code (NMAC) 8.290.400.

If an applicant meets the criteria, they will receive a “Yes Match” letter, placing them on the Wait List for services.

Required Documentation for Eligibility Review

Applicants, their guardians, or an authorized representative must submit documents that establish proof of a developmental disability (DD) or related condition.

The following documentation is reviewed to determine eligibility:

Educational & Psychological Evaluations

  • Educational Evaluations
  • Individualized Education Program (IEP)
  • Review of Existing Evaluation Data (REED)
  • Multidisciplinary Evaluation Reports

Medical & Diagnostic Records

  • Neuropsychological/Psychological Evaluations
  • Medical Diagnosis Reports
  • Autism Spectrum Disorder (ASD) Evaluations

📌 Important:

  • Keep original documents and submit copies to DDSD.
  • Documentation is reviewed based on the current DD Waiver eligibility definition.

Second-Level Review for Certain Conditions

If an applicant has additional mental health diagnoses or other conditions alongside an intellectual disability (ID) or related condition, their case may require a second-level review by a licensed practitioner.

This extra review ensures that the applicant meets the DD criteria before final eligibility approval.

What Happens After Eligibility Determination?

Once DDSD completes the review, applicants receive one of the following:

“Yes Match” Letter

  • Confirm eligibility for the DD Waiver.
  • Places the individual on the Wait List for services based on their registration date.

Request for Additional Documentation

  • If further information is needed, DDSD will notify the applicant or their guardian.

Denial of Eligibility

  • If an applicant does not meet the eligibility criteria, they will receive a formal notification.
  • Individuals can appeal the decision through DDSD if they believe the determination was incorrect.
