Understanding Home and Community-Based Services HCBS Waivers in New Mexico
What Are HCBS Waivers?
Home and Community-Based Services (HCBS) Waivers help individuals with intellectual and developmental disabilities (IDD) live independently in their communities while receiving the care and support they need.
In New Mexico, the Developmental Disabilities Supports Division (DDSD) offers two primary waivers:
- Developmental Disabilities (DD) Waiver – Provides services for individuals with IDD to live successfully in the community.
- Mi Via Waiver – A self-directed waiver that allows individuals to have greater control over their services and care providers.
These waivers are designed to increase independence and help individuals reach their personal goals in a community-based setting rather than an institutional facility.
Who is Eligible for HCBS Waivers?
To qualify for an HCBS Waiver in New Mexico, individuals must meet the definition of developmental disability as defined in New Mexico Administrative Code (NMAC) 8.290.400.
Eligibility Requirements:
An individual must have:
✅ An Intellectual Disability with onset before age 18 OR
✅ A Related Condition (such as Cerebral Palsy, Autism Spectrum Disorder, Down Syndrome, or Epilepsy) with IQ or adaptive behaviors similar to someone with an intellectual disability that began before age 22.
AND
✅ Substantial functional limitations in at least three (3) major life activities, including:
- Self-care (eating, bathing, dressing).
- Receptive and expressive language (understanding and communicating).
- Learning (problem-solving and adapting to new situations).
- Mobility (independently moving around).
- Self-direction (decision-making and goal-setting).
- Independent living skills (managing day-to-day life activities).
If an individual meets these criteria, they may be eligible for HCBS Waiver services in New Mexico.
How to Apply for HCBS Waivers
Applying for DD or Mi Via Waiver services is a multi-step process that starts with submitting an application to DDSD.
Step 1: Complete the Application Packet

Step 2: Submit the Application
- The date DDSD receives your application becomes your Central Registry application date (this determines your place on the Wait List).
- DDSD will assign a Pre-Service Specialist to review your application and confirm eligibility.
Step 3: Eligibility Determination
- If the application is complete, DDSD will determine if the applicant meets DD eligibility criteria.
- If more information is needed, DDSD will notify you.
Step 4: Placement on the DD Waiver Wait List
- If eligible, DDSD will send a “Yes Match” letter, confirming the individual has been placed on the Wait List.
- Applicants are removed from the Wait List based on their application date when funding becomes available.
Services Available While on the Wait List
Since HCBS Waivers have a Wait List, individuals may qualify for alternative services while waiting for funding.
1. State General Funds (SGF)
- Limited services available for individuals who have completed eligibility but are still waiting for waiver allocation.
- Contact your regional State General Funds Liaison for details on available supports.
2. Centennial Care Community Benefits
- If you are a Medicaid recipient, you may qualify for Centennial Care Community Benefits.
- Contact your Managed Care Organization (MCO) to learn about additional resources.
These services provide temporary support while individuals wait for full waiver allocation.
Receiving an Allocation for HCBS Waivers
When funding becomes available, DDSD will mail a Letter of Interest and the Primary Freedom of Choice (PFOC) form to eligible individuals.
📌 Important: The letter is sent to the address DDSD has on file in the Central Registry. Ensure your contact information is always updated with your assigned Pre-Service Specialist.
Once funding is allocated, individuals can begin receiving full HCBS Waiver services, including:
- Personal care assistance
- Behavioral and therapy services
- Respite care
- Supported employment
- Assistive technology
